C. PRIVACY POLICY
THE LEGAL AGREEMENTS SET FORTH BELOW GOVERNS YOUR USE OF ALL FREEDCAMP, LLC SERVICES. IF YOU AGREE TO THESE TERMS, CLICK "AGREE." IF YOU DO NOT AGREE TO THESE TERMS, DO NOT CLICK "AGREE," AND DO NOT USE THE SERVICES.
A. TERMS OF SALES
FREEDCAMP, LLC accepts these forms of payment: Credit/debit cards issued by U.S. banks and/or payments through a PayPal account. If a credit card or PayPal account is being used for a transaction, Freedcamp may obtain preapproval for an amount up to the amount of your order. Billing will occur on the 1st of every month, regardless of your purchase date or the number of applications or storage purchased. Each application will have an expiration date of 30 days. Users will be billed beginning each month for the prior and subsequent period for each Application purchased (See Ex. below for further explanation). Freedcamp offers a free two-day trial on all new purchased Application(s), which begins on the date of purchase. The 30 day expiration date for all newly purchased Application(s) will begin after the 2 day free trial, giving Users a total of 32 days. All subsequent periods will have continue the 30 day expiration guidelines. Canceling and then renewing an application will void the two-day trial for all future purchases.
Ex. 1
A $2.00 Application first purchased on 7/5/2011 will have an expiration date of 8/5/2011, 32 days beginning 7/5/2011. Users will be billed $2.00 on 8/1/2011 for the period of 7/5/2011 – 8/5/2011. User will be billed another $2.00 on 9/1/2011 for the period from 8/6/2011 – 9/4/2011 and every subsequent first of every month.
- If User cancels subscription between the initial period from 7/5/2011 – 8/5/2011, User will only be billed $2.00 on 8/1/2011 for that period. User must cancel the Application(s) subscription during the two day trial in order to avoid any charges.
- If User cancels subscription after 8/5/2011, User will still be billed $2.00 on 9/1/2011 for the period from 8/6/2011 – 9/4/2011. User will still be able to use the Application until the expiration date of 9/4/2011.
- If User cancels the subscription before 8/1/2011, Users will still be charge $2.00 for the period from 7/5/2011 – 8/5/2011. Users may still use the Application until 8/5/2011. The Application will stop after the expiration date and no further billing will occur.

Ex. 2
A $2.00 Application was purchased on 6/15/2011 and a $3.00 Application was purchased on 6/25/2011 will both be billed on 7/1/2011. User will be charged $5.00 on 7/1/2011 for first expiration period. User will then be charged another $5.00 on 8/1/2011 for the second expiration period.
You agree to pay for all products purchased through Freedcamp’s Marketplace. Freedcamp, LLC may charge your account automatically every month for the continual use of the application. Any nonpayment by the User will result in the expiration and unavailability of application(s) until payment resumes If nonpayment continues for longer than a period of 30 days, Freedcamp reserves the right to delete and remove any personal or private data saved on the application(s). (Please see Freedcamp’s Rights for further detail regarding nonpayment). YOU ARE RESPONSIBLE FOR THE TIMELY PAYMENT OF ALL FEES AND FOR PROVIDING FREEDCAMP WITH A VALID CREDIT/DEBIT CARD OR PAYPAL ACCOUNT DETAILS FOR PAYMENT OF ALL FEES. All monthly fees will be billed to the credit/debit card or PayPal account you designated during the registration process. If you wish designate a different credit/debit card or changes in your PayPal account, you must change your information online under your Account settings. It is your responsibility to stop the monthly payments if you no longer wish to use the applications. You may contact Freedcamp through our Contact Links regarding any payment changes.
Your total price will be the cost of the applications, plus any applicable fees and sales tax. We will only charge sales tax in states where digital goods are taxable.
REFUND and CANCELLATION POLICY
Freedcamp will not offer a full refund unless major problems and bugs exist within our applications and are not fixed in a timely manner. It is your responsibility to inform Freedcamp of any application errors. Users are given two days after the original date of purchase to cancel any new applications subscription without being charge. After the two days period, refunds will only be permitted due to technical errors of the applications. User may submit a request for refund by stating out the appropriate grounds for a refund. Freedcamp will consider each individual refund request but is not obligated to grant User(s) a refund just based on the submission of a request. YOU MAY NOT REQUEST A REFUND IF YOU HAVE ALREADY USED THE APPLICATIONS FOR OVER 2 WEEKS IN THE MONTH PURCHASED.
User will be charged on the first of every month for all purchases made during that period. The charges will be automatically billed on the first of every subsequent month to extend the expiration period. User must cancel the Application subscription before the next payment period in order to avoid recurring charges for subsequent months. If User cancels their subscription before the next billing date, User will still be charge on the first of that month for the current expiration period, but no further charges will incur. User may still use the Application until the original expiration date. All Application data will be saved for 30 days if User wishes to continue their subscription at a later period. After 30 days expires, all stored data will be deleted. It is up to the User to timely renew their subscription. Please refer to Terms of Sales for scenario examples.
FREEDCAMP’s RIGHTS
Freedcamp, LLC reserves the right to:
A. Close accounts and request alternative forms of payments if current forms of payment is fraudulently obtained or used on Freedcamp’s Marketplace.
B. Cancel any transaction if we believe the transaction violates the Terms of Sales,
or we believe doing so may prevent financial loss.
C. If billing error occurs, on date of billing, due to:
· credit/debit card decline,
· misrepresented financial information,
· or User negligence,
Users have until the expiration date of each Application to make payment for the current period. If no payment is received by the end of the expiration period, Freedcamp reserves the right to stop all functionality of any unpaid Application until payment is received. Any stored Application data will be saved for 30 days after the expiration period. If User eventually resumes payment within those 30 days, all saved Application data will be restored. If no payment is received during the 30 day, all Application data will be deleted. It is the User’s responsibility to meet all financial obligations and make prompt payments within the set time period.
D. Make any inquiries that we consider necessary, either directly or through thirdparties, regarding User identities and creditworthiness.
E. Start charging for any free Applications or make any previously paid Application
free. No refunds will be issue as a result from these changes.
ELECTRONIC CONTRACTING
Your use of Freedcamp’s Marketplace includes the ability to enter into agreements and/or to make transactions electronically. YOU ACKNOWLEDGE THAT YOUR ELECTRONIC SUBMISSIONS CONSTITUTE YOUR AGREEMENT AND INTENT TO BE BOUND BY AND TO PAY FOR SUCH AGREEMENTS AND TRANSACTIONS. YOUR AGREEMENT AND INTENT TO BE BOUND BY ELECTRONIC SUBMISSIONS APPLIES TO ALL RECORDS RELATING TO ALL TRANSACTIONS YOU ENTER INTO ON THIS SITE, INCLUDING NOTICES OF CANCELLATION, POLICIES, CONTRACTS, AND APPLICATIONS. It is your responsibility to have all appropriate hardware and software that allows you access to your electronic records. If you are under the age of 18, you may only make payments with the approval of a parent or guardian. We request that you review the Terms of Sales with your parents or guardian.
B. TERMS AND CONDITIONS
THIS LEGAL AGREEMENT BETWEEN YOU AND FREEDCAMP, LLC GOVERNS YOUR USE OF FREEDCAMP, LLC and the FREEDCAMP MARKETPLACE.
FREEDCAMP
Freedcamp is the provider of a free Project Management System that permits you to collaborate, communicate and operate your projects with your team members on our platform.
REQUIREMENTS FOR USE
Freedcamp is available for individuals aged 13 and older. If you are below the age of 13, please review this Agreement with your parents or legal guardians before using Freedcamp.
The use of Freedcamp requires a compatible device, internet access, and compatible software. Your ability to use Freedcamp and the performance of our service may be affected by these factors. Such system requirements are your sole responsibility.
YOUR ACCOUNT
As a registered User of Freedcamp, you may create an Account. Do no share your Account information to anyone else, less you do so at your own risk. You are solely responsible for maintaining the confidentiality and security of your Account and all activities relating to your Account. If your account has been compromised, you agree to immediately notify Freecamp of your Account; failure to promptly notify Freedcamp of any security breach is at your own risk. Freedcamp will not be responsible for any losses arising out of the unauthorized use of your Account.
In order to use Freedcamp, you must enter your USER NAME and PASSWORD. Once you have authenticated your Account, you will have access to Freedcamp’s Project Management System platform and your applications(free or previously purchased). During this time, you will be able to use our collaboration system or purchase additional applications on our Marketplace. (See our Terms of Sales for further detail on purchasing Applications through Freedcmap.)
You agree to provide all accurate and complete information when registering an Account and you agree to update your Account to further reflect the accuracy and completeness of your information. You agree that Freedcamp may store and use the Account information you provided in maintaining and billing fees to your Account.
YOUR CONTENTS AND INFORMATION
You, the User, are responsible and own all content, information or uploaded files you post through Freedcamp, and you can control how your information is shared through Freedcamp. You specifically grant Freedcamp permission to share your content and information with other team members of your project groups. You acknowledge that this agreement will end when you delete your Account unless you shared your information with your team members, and they still own and operate their Account in your group. You understand that even after you deleted your Account, online data may still be stored in backup data for periods of time but will not be available to an third parties.
In addition to the above agreement you also agree not to: 1) use Freedcamp to conduct any unlawful or fraudulent activities, 2)upload any viruses and malicious code, 3)collect information from other Users in an unlawful matter, 4)harass or threaten other Users, 5)post hateful, threatening, pornographic content, violent, or any nudity or graphic contents, and 6)do anything that would threaten or damage the operation of Freedcamp’s online Project Management System.
PRIVACY
Freedcamp’s Privacy Policy applies to the use of Freedcamp’s Project Management System and the terms are made a part of these Terms and Conditions by this reference. Additionally, by using Freedcamp’s online Project Management System, you agree and acknowledge that the internet is never completely private and secure. You understand any information you post, upload and share with others Users through Freedcamp may be read or intercepted by others, even if there is a special notice that a particular data(ex. Credit card information) is encrypted. Please refer to Freedcamp’s Privacy Policy for further detail.
INDEMNITY
You agree to indemnify and hold Freedcamp, its officers, investors, successors in interest, employees, and associates harmless from any demands, loss, liabilities, claims or expenses(including attorneys’ fees), made against Freedcamp by any third party due to or arising out of or in connection with your use of Freedcamp.
AMENDMENTS
Freedcamp holds the right to make changes to our Terms and Conditions without notice should we find it necessary to do so. Freedcamp may or may not notify User of changes, it is your responsibility to keep yourself updated with our Terms and Conditions.
VIOLATION OF THE TERMS AND CONDITIONS
Freedcamp may disclose any information we have about you(including identity) if we find that such disclosure is necessary relating to any investigation or complaint regarding your use of Freedcamp’s online Project Management System, or to identify, contact and take legal action against someone who may be misusing or interfering with Freedcamp’s rights and property, or the rights or property of Users of this site. Freedcamp reserves the right at all times to disclose any information that Freedcamp deems necessary to comply with any applicable law, regulations, or Federal process. Freedcamp may also disclose your information when Freedcamp applicable laws requires or allows such disclosures, including conducting acts of fraudulent activities. You agree that Freedcamp may, at our discretion and without prior notice, terminate your access to our website and/or block your future access to Freedcamp if we determine that you have violated our Terms and Conditions. You also agree that Freedcmap may, at our discretion and without prior notice, terminate your access to Freedcamp for any cause including, but not limited to: 1) request by law officials or governmental agencies, 2)a request by you, self termination, and 3) unexpected technical difficulties or problems
If Freedcamp ever take legal action against you as a result of your violations of our Terms and Conditions, Freedcamp is entitled to recover from you all attorney fees and cost of legal action including any damages and fees incurred by Freedcamp. Freedcamp is not liable for you or any third party as a result of your Account termination due to your violation of our Terms and Conditions.
C. PRIVACY POLICY
This Privacy Policy governs the manner in which Freedcamp collects, uses, maintains and discloses information collected from Users (each, a "User") of the http://www.freedcamp.com website ("Site"). This privacy policy applies to the Site and all products and services offered by Freedcamp, LLC.
PERSONAL IDENTIFICATION INFORMATION
We may collect personally identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, register on the site, and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, name, email address. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.
NON-PERSONAL IDENTIFICATION INFORMATION
We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.
WEB BROWSER COOKIES
Our Site may use "cookies" to enhance User experience. User's web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. User may choose to set their web browser to refuse cookies, or to alert you when cookies are being sent. If they do so, note that some parts of the Site may not function properly.
HOW WE USE COLLECTED INFORMATION
Freedcamp collects and uses Users personal information for the following purposes:

- We may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Site.
- - To improve our Site
- We continually strive to improve our website offerings based on the information and feedback we receive from you.
- - To improve customer service
- Your information helps us to more effectively respond to your customer service requests and support needs.
- - To administer a content, promotion, survey or other Site feature
- To send Users information they agreed to receive about topics we think will be of interest to them.
- - To send periodic emails
- The email address Users provide will only be used to respond to their inquiries, and/or other requests or questions. If User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. If at any time the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email.
HOW WE PROTECT YOUR INFORMATION
We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, Username, password, transaction information and data stored on our Site.
SHARING YOUR PERSONAL INFORMATION
We do not sell, trade, or rent Users personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and Users with our business partners, trusted affiliates and advertisers for the purposes outlined above. We may use third party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys. We may share your information with these third parties for those limited purposes provided that you have given us your permission. We may share your First/Last names and avatar with others users within Freedcamp. We also reserve the right to freely moderate all comments made within Freedcamp. Even though Freedcamp owns the code, databases and rights to our applications, you, the Users, retain al rights to the data you share and upload. Under special circumstances, Freedcamp reserves the right to disclose your personal information should it relate to any legal matter or proceedings or if you have violated our Terms and Conditions.
CHANGES TO THIS PRIVACY POLICY
Freedcamp has the discretion to update this privacy policy at any time. When we do make changes, we will post a notification on the main page of our Site and send you an email. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.
YOUR ACCEPTANCE OF THESE TERMS
By using this Site, you signify your acceptance of this policy. If you do not agree to this policy, please do not use our Site. Your continued use of the Site following the posting of changes to this policy will be deemed your acceptance of those changes.
